How can they be used? The photo collection Dr. Polsky maintains of injuries sustained by dog bite victims is a unique copyrighted collection. Privacy issues prohibit the publication and distribution of most of the photos in this collection, however. The collection of photo clearly shows the distinctive physical features of wounds to people caused by dog bites. The photos are helpful in distinguishing a dog bite injury from one that is not. For example, occasionally in litigation stemming from a dog bite incident, an attorney needs to know if the injury was in fact the result of a dog bite. Comparing an injury to injuries actually caused by a dog bite may resolve the issue. Dr. Polsky can help in this regard. Dr. Polsky has no expertise in the medical treatment of dog bite wounds. However, he has expertise in recognizing the physical features of a dog bite injury. For example, in one recent civil case in California where the defense disputed that the injury was caused by a dog bite, the testimony of Dr. Polsky helped resolve the issue. In addition to the physical characteristics of a dog bite, other important factors may be considered in determining whether the plaintiff was bitten by a dog; namely whether the dog in question possessed the temperament to bite a person, and the physical features of locale where the incident took place (e.g. height of a fence or space between wrought iron bars). |
