Expert testimony California dog bite expert – canine aggression

By Richard Polsky, Ph.D. – Animal Behavior Expert Witness

In personal injury cases involving dog attacks, the behavior of the dog is often at the center of the legal dispute. But courts cannot resolve questions about canine aggression without the help of science-based analysis. As a court-qualified expert witness and Ph.D.-level animal behaviorist, I provide attorneys in California with authoritative, courtroom-ready evaluations on the causes and context of dog aggression.

Canine aggression is multifactorial and context-specific, influenced by genetics, environment, learning history, and the owner’s handling of the animal. My expert testimony draws from decades of scientific research and direct casework to clarify whether a bite incident was provoked, foreseeable, or preventable.

Why Expert Testimony on Aggression Matters

Dog bite cases often turn on key legal questions that require behavioral interpretation:

  • Was the dog’s aggression predictable based on prior behavior?

  • Was the attack provoked or unprovoked?

  • Did the dog act in a way consistent with fear, territoriality, or redirected frustration?

  • Was the owner negligent in failing to control a known risk?

To answer these questions, courts require more than general veterinary input—they need expert behavioral interpretation backed by peer-reviewed science (Overall, 2013; Horwitz & Mills, 2009).

Types of Aggression Commonly Evaluated

Understanding the subtype of aggression involved is essential. My evaluations classify the dog’s behavior according to recognized categories in clinical animal behavior, such as:

  • Territorial Aggression
Defensive aggression directed at individuals perceived as intruding on the dog’s home range or space (Landsberg et al., 2013).

  • Fear-Based Aggression
Aggression arising from a dog’s perception of threat or inability to escape, particularly when cornered or physically restrained (Mills et al., 2014).

  • Resource Guarding (Possessive Aggression)
Aggression exhibited when a dog protects food, toys, or people, often triggered by an attempt to remove or approach the guarded item (Jacobs et al., 2020).

  • Leash-Related Aggression
Also known as frustration-induced aggression, common in dogs that react aggressively when physically restrained during arousing stimuli such as approaching dogs or people (Herron et al., 2009).

  • Predatory or Misclassified Play Aggression
In some cases, high-arousal behavior or poorly inhibited play may escalate into harmful biting—especially in working breeds with strong prey drive.

Each case requires detailed behavioral reconstruction, including review of the dog’s history, environment, provocation factors, and owner response.
